[Read more…] about I just saw our association’s budget and was surprised to see the huge amount budgeted for Legal Expense. We could probably hire two full-time attorneys for what is budgeted. Is there a formula for figuring out what appropriate annual legal expenses should be based on an association’s size and overall budget? The amount my community plans to spend seems excessive.

[Read more…] about We recently updated our community’s rules and regulations regarding ARB approvals. In those changes, the buffer a resident installed to a propane tank was deemed to be in violation. The original buffer confirmed to the existing regulations and was approved by the ARB when installed, but the ARB was controlled by the builder at the time. Is the current board under any obligation to honor the prior documented approval?
[Read more…] about A single woman owns a townhouse in our managed community and voiced her concern about the lack of street lighting. While a “lighting district” worked with the builder and utility about street lighting, there are areas with no lighting. The owner has anxiety about her perceived lack of safety. My question is: who is responsible to solve this problem? What are the positives and negatives for the HOA to be involved?
[Read more…] about One resident constantly complains about another resident who is in violation of a HOA rule. As a board we are aware of the violation but allow the situation because of the personal situation involved. We have communicated to the complaining resident we do not wish to discuss why we allow this violation. Do we have to provide an answer?

It’s less money to just have it cleaned up compared to getting the current owner to clean it up. We would have permission from the owner. As a board can we approve or do we need to advise all the owners for their input?
[Read more…] about If one is in compliance with the HOA’s By-Laws when adding a structure to one’s property, but the Board cannot substantiate their reasons for denying one’s structure with the said By-Laws or any official HOA document, what options are there? If the HOA By-Laws don’t define what a “structure” is and there are 20+ structures in the community (pool houses), can a resident be denied a “shed”?
